PhoenixLabs.AI, Inc., a Nevada corporation (“Phoenix Labs,” “we,” “us,” or “our”) provides an AI-powered platform for interactive content experiences, including the Firebird interactive podcast platform and any associated APIs and developer tools. This Privacy Policy explains how we collect, use, disclose, and protect information when you access or use our website located at https://www.phoenixlabs.ai and all related software, applications, tools, APIs, and any other online and offline services provided by Phoenix Labs (the “Services”). Specifically, this Privacy Policy explains: how we collect non-public information about you that can be used alone or in combination to identify you (“Personal Information”), how we use your Personal Information, and how we protect your privacy.

Privacy Principles

A

Personal Information We Collect

We take your privacy seriously. Consistent with applicable law, we:

  • collect only Personal Information necessary or relevant to providing the Services.
  • use legitimate and proportional methods to collect Personal Information.
  • take reasonable steps to ensure Personal Information we act upon is accurate and timely.
  • limit internal access to authorized personnel trained to handle Personal Information.
  • use industry-standard security measures to protect Personal Information.
  • do not sell Personal Information.
  • share Personal Information externally only as outlined in this Privacy Policy and as permitted by law.

We obtain most Personal Information directly from you, including when you create an account or use the Services. This may include:

  • First and last name
  • Company name (if applicable)
  • Email address
  • Phone number
  • Financial or other information you enter, upload, import, or sync with the Services (collectively, “Inputs,” and as further defined in our Terms of Service)
  • Payment information collected by our third-party payment processor (we do not store full card numbers)

You retain ownership of your Inputs.

We may collect:

  • IP address
  • Browser type
  • Device identifiers
  • Pages viewed
  • Actions taken within the Services
  • Content navigation and exploration paths, including the sequence in which you browse, discover, and traverse content, tags, and collections within the Services (used to power personalized recommendations and AI agent features)
  • Log files
  • Cookies, web beacons, and similar technologies (“Tracking Tools”)

You may control cookies through your browser, but doing so may limit functionality.

We receive information from integration partners required to deliver the Services, including podcast hosting platforms, media storage services, streaming platforms (that may include YouTube), analytics tools, payment processors, and other integration partners. Any of your use of YouTube-integrated features is also subject to Google's Privacy Policy (available at https://policies.google.com/privacy). In addition, our AI agent features are built on top of third-party AI infrastructure providers. Currently, the primary provider is OpenAI, L.L.C. (“OpenAI”), whose models and API services power our AI agent functionality. We act as the data controller with respect to your interaction data, and OpenAI acts as a data processor or subprocessor processing that data solely on our instructions and to provide the Services. OpenAI's enterprise data practices are described at https://openai.com/enterprise-privacy; under those terms, your interaction data (inputs and outputs) is not used to train OpenAI's models by default. We may in the future engage additional third-party AI infrastructure vendors operating on similar terms, and we will update this Privacy Policy to identify any such material additions.

How We Use Personal Information

We use your Personal Information in the following ways:

  • Creating and managing user accounts;
  • Generating AI-powered interactive content experiences, including personalized feeds, curated playlists, interactive “nests,” live transcriptions, subtitles, content recommendations, and other informational and entertainment outputs (for informational, creative, and entertainment purposes only; we do not provide legal, investment, accounting, or other professional advice);
  • We use your interaction data — including plays, skips, saves, listening history, and content navigation paths — to power a personalized recommendation engine that dynamically ranks and adapts your content feed based on your behavior and preferences. This data is used to improve content relevance over time and is not used to build profiles for purposes unrelated to the Services.
  • Importing or syncing financial-account data, where applicable and as authorized by you;
  • We do not sell your Inputs or Outputs and will only use them in accordance with this Privacy Policy and our Terms of Service. We will not engage in cross-context behavioral advertising using your Inputs or Outputs.
  • Our AI agent features may take automated actions on your behalf within the Services, such as saving bookmarked content, organizing content into collections, and generating suggested content groupings based on your activity. These automated actions are governed by your account preferences, and you may enable or disable specific automated behaviors through your account settings. All automated actions are performed on your behalf using your interaction data and are subject to the same data handling practices described in this Privacy Policy.
  • We do not use your personally identifiable Inputs, Outputs, or Personal Information to train or improve any third-party artificial intelligence or machine-learning models. We may use anonymized or aggregated interaction data, including chat logs and transcripts, to train, refine, and improve our own internal AI models and Services. Outputs may depend on the accuracy and completeness of your Inputs and any imported or synced data.

Note: Outputs are generated by automated AI systems and may be incomplete, inaccurate, incorrect, or otherwise inappropriate for your specific circumstances. AI-generated citations produced through the Services, are provided for informational reference purposes only; Phoenix Labs does not warrant that any such citation accurately represents or faithfully reproduces the substance of the underlying source material. You are solely responsible for reviewing, editing, and verifying the accuracy, completeness, and appropriateness of all Outputs - including any AI-drafted communications or avatar scripts - before relying on or transmitting them for any purpose. Phoenix Labs does not provide tax, legal, accounting, or financial advice.

Sharing of Personal Information

We may share Personal Information only with:

1) Service Providers

Including:

  • Hosting providers
  • Cloud infrastructure vendors
  • Data-security and backup vendors

These providers may access Personal Information only to perform services on our behalf. We use third-party authentication providers to manage user login security, and authentication information is processed according to the applicable provider's privacy policy. We use a third-party payment processor to handle all payment card information, and Phoenix Labs does not store full payment card numbers.

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, Personal Information may be transferred to the acquiring entity or successor, subject to the commitments made in this Privacy Policy.

We may disclose Personal Information to government agencies, courts or for purposes of legal process, and law-enforcement authorities. Where legally permitted, we will use reasonable efforts to notify you before producing information in response to a subpoena or legal request.

5) Aggregated and Anonymized Information

We may use or share aggregated, de-identified data that does not identify you. We may also use de-identified information to analyze usage trends and improve the Services.

6) Social or Public Features

If you post on public areas of the Services (if enabled in the future), that information may become publicly visible.

7) Creators

If you interact with creator-published content on the Services, certain limited Personal Information - such as your username, interaction data (e.g., plays, saves, or comments), and aggregated engagement metrics - may be shared with the applicable content creator. Creators are required to handle any such information in accordance with applicable law and may not use it for purposes unrelated to their content and communications on the Services.

Retention, Confidentiality, and Security

We use administrative, technical, and physical safeguards designed to protect Personal Information, including encryption of data in transit and at rest. We may retain chat logs, transcripts, and records of your interactions with AI agents in anonymized or aggregated form solely for purposes of training, refining, and improving our own internal AI models and Services; we do not use such retained data in personally identifiable form and do not share it with third parties for AI training purposes. If a security breach occurs that affects your Personal Information, we will notify you via email or through the Services as required by applicable law.

When you delete records within the Services without deleting your entire account, the records may be soft deleted and retained temporarily to preserve data integrity. Soft-deleted data is permanently removed when your account is deleted. If you delete your account with us, we use commercially reasonable efforts to delete all of your Personal Information from our Services. You should not rely on the Services as your sole repository for important data.

Children's Privacy

The Services are not directed to children under the age of 13 (or such higher age as may be required by applicable law in your jurisdiction). We do not knowingly collect Personal Information from children. If we learn that we have collected Personal Information from a child without verifiable parental consent, we will delete that information promptly and terminate any such account upon discovery. Additional Relevant Provisions and Laws

Phoenix Labs is a Nevada corporation. The Services are intended for U.S. users only. Persons located outside the United States may not use the Services without Phoenix Labs' express prior written permission. If you access the Services from outside the U.S., you agree that your information will be transferred to and processed in the United States.

California Residents (CCPA / CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

  • The right to know what Personal Information we collect, use, disclose, or share about you
  • The right to delete Personal Information we have collected from you, subject to certain exceptions
  • The right to correct inaccurate Personal Information we maintain about you
  • The right to opt out of the sale or sharing of your Personal Information (we do not sell Personal Information)
  • The right to limit our use and disclosure of sensitive Personal Information
  • The right not to be discriminated against for exercising your privacy rights

International Visitors

We may also transfer your data, including Personal Information, from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including Personal Information, to us, you consent to such transfer, storage, and processing.

Apple App Store Users

If you access the Services through an application downloaded from the Apple App Store, the following additional terms apply: (a) Apple Inc. (“Apple”) is not a party to this Privacy Policy and has no obligation to provide any maintenance or support services for the Services; (b) Apple is not responsible for addressing any claims by you or any third party relating to the Services or your use of the Services, including product liability claims, consumer protection claims, or intellectual property infringement claims; (c) in the event of any failure of the Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the application; and (d) your use of the Services is also subject to the Apple Media Services Terms and Conditions and Apple's Privacy Policy. Apple and Apple's subsidiaries are third-party beneficiaries of this provision and, upon your acceptance, will have the right to enforce this provision against you as a third-party beneficiary.

You may opt out of marketing emails, manage cookies via your browser, or request access, correction, or deletion (where legally applicable). We may require identity verification before responding.

Changes to this Privacy Policy

We may modify this Privacy Policy from time to time. If changes are material, we will notify you by email or through the Services and, where required by applicable law, obtain your affirmative consent before applying such changes to your Personal Information. Your continued use of the Services after the effective date of any non-material modifications constitutes acceptance of the revised Privacy Policy.
